A 26 year old motorcyclist was sideswiped by a motor vehicle making a right turn and was thrown off the mororcycle, sustaining a torn ligament and joint separation of the shoulder requiring two surgeries, and a large laceration of the toe that required sutures. Plaintiff returned to full-time work three months after the accident. He later developed impingement syndrome of the ankle that was treated with arthroscopic surgery. Defendants argued that the plaintiff was speeding, and produced a witness who corroborated their position that the defendant had stopped at the stop sign before making the turn.
