$300,000 for 48 year old male struck at a toll booth.
Plaintiff, a 48 year old male, weighing 375 lbs, was struck in the rear at a toll booth. He sustained only moderate damage to his vehicle and refused medical treatment at the scene. Two days later, he sought emergency room treatment for lower back pain. He underwent two years of medical treatment including epidural injections, but no surgery. Barry Weiss was able to convince an arbitrator that despite plaintiff's size and age, his injuries were traumatically related and not the product of pre-existing degeneration. Mr. Weiss was also able to convince the arbitrator that the injuries had a profound effect on plaintiff's lifestyle. The arbitrator awarded him the maximum amount avialable under the automobile insurance policy.
