Driver awarded $450,000 for partial rotator cuff tear sustained in intersection collision with taxi.
  Plantiff, a 59 year old male, was driving through an intersection when his car was struck by a livery car that ran a red light while fleeing another accident. As a result, he sustained a partial tear of his labram and supraspinatus tendon of his right shoulder, which was addressed via arthroscopic surgery. Defendant refused to offer more than $15,000 to settle the case and argued that he was not responsible for causing the accident and that, even if he was, plaintiff did not complain of pain in his right shoulder until the day after the accident and, furthermore, that the accident could not have caused plaintiff's injuries. Erik L. Gray tried the case to verdict and then defeated defendant's post-trial motion to set aside the verdict.
