$225,000 settlement for 66 year old pedestrian struck while crossing street during thunderstorm at night while not in crosswalk.
  Plaintiff, a 66 year old male, was crossing the street near his home when he was struck by a minivan. As a result, he sustained, among other things, a fracture of his left proximal fibula and tears of his supraspinatus tendon of his right shoulder, medical meniscus of his left knee, and ACL of his right knee. All three tears were addressed via arthroscopic surgeries. Defendants argued that plaintiff was at least half at fault for causing the accident since he should have seen the minivan and especially because he was not crossing in a crosswalk and it was dark and raining at the time. Defendants also argued that all three surgeries were unrelated to the accident and were due to plaintiff's pre-exisiting injuries/conditions to his right shoulder and knees. Amy Rosenbloom and Erik L. Gray obtained the settlement at a mediation prior to trial in Suffolk County.
